First Choice Armor (FCA) has acquiesced and agreed to a settlement in the above case. The settlement, which has been preliminarily accepted by the federal Court, provides a cash refund or a free replacement vest for anyone who purchased, used or uses any FCA vest that contains any amount of Zylon®. "First Choice refused to promptly and properly respond to the Zylon® issue, disregarding officer safety," said P.B.A. staff attorney Grady K. Dukes. "It was only through the efforts of Southern States PBA, the other plaintiffs, and lead counsel Pitts Carr and David Cohen, that we have reached this stage of the proceedings."
