VAPBA Legislative Update

The short session of the General Assembly is underway and bill filing is completed. Attached you can view bills of interest to the law enforcement community.

I would like to thank ABC Chapter President Brian Edwards and David Deaton who traveled to Richmond to work with me on HB 2247. We met with several committee members and finally with the bill patron Delegate Chris Jones. Delegate Jones informed us that the bill was submitted to make a correction on some unintended language in an earlier bill impacting ABC.

Members Rob Farrell and Jeff Rice also joined me in Richmond to lobby a bill that Newport News submitted to bring Park Rangers into the definition of law enforcement officer, SB 1385. The measure was heard by the Senate Courts of Justice Committee where it was not reported out, meaning it will not be advanced this year. There is a duplicate bill in the House, HB 2062, which is also expected not to advance past the Senate. Representatives from the Sheriffs Association and the Chiefs of Police Association spoke against the bill in the Senate.

Delegate Miller introduced HB 2336 after the Attorney General ruled that on duty officer involved vehicle crashes were subject to reporting to the officers personal insurance carrier. This bill, if passed, will keep in place the practice of not reporting on-duty crashes to officers personal insurance companies. The Department of Motor Vehicles has reported that they will not report any on duty crashes until this bill would take effect in July 2018. The State Police representative, IACP representative and Sheriffs Association representative, and I all spoke in support of the bill which passed out of Transportation Sub Committee 2 unanimously.

Delegate Chris Collins agreed to submit our bill that would protect the identity of an officer involved in a critical incident. When Delegate Collins submitted the bill Legislative Services informed him that Delegate Miller had already submitted the measure. Delegate Collins then signed on a Chief Co-Patron of HB 2043. I attempted to get several Democrat legislators to sign on as patrons but as of today none have. This bill will be heard in General Laws Sub Committee on Thursday afternoon.
